I don’t know. The court could rule (as Judge Surrick ruled in the Berg case) that as “only a citizen” Donofrio has no standing because he can not prove how he was damaged by the fraudulent candidacy. I doubt they will cop out like that but they can. The case that really has legs is the American Independent Party/Alan Keyes suit because they DEFINITELY have standing and can prove damages. If Obama is illegal he was not eligible to run for the Senate seat in the first place.
